NEW UNION ELECTION RULES STRUCK DOWN
The National Labor Relations Board's ("NLRB" or the "Board") new prompt election rules, which were supported by the unions, became effective on April 30, 2012. These new rules were challenged in federal court in Washington, D.C. That court ruled on May 14, 2012, that the new rules were invalid and unenforceable because the NLRB did not have a quorum when it voted on the rules. The court stated, however, that a properly constituted quorum might approve the changes if it wished to do so, thus opening the way for the Board to re-adopt the new rules. The new rules, if and when implemented, will greatly reduce the time period from the date on which a representation petition is filed and the election is held and will allow unions to include supervisors in the unit, thus excluding them from active participation in convincing employees not to vote for the union.
