1. 2. Instructions on how to claim and the offer form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. This offer is not valid in conjunction with any other offer. Claims are only open to Australian residents aged 18 years old or over. Employees (and their immediate families) of Salton (Aust) Pty Ltd ABN ("Promoter"), participating retailers and agencies associated with this promotion are ineligible to claim. In these Terms and Conditions "immediate families" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or rst cousin. For the purpose of these Terms and Conditions, "purchase" means payment in full of the Participating Product. The promotion excludes Participating Products purchased through any online retailer other than Salton (Aust) Pty Ltd, online bidding or auction websites (including www.ebay.com.au) or otherwise purchased through unauthorised retailers. To claim, claimants must provide: their full contact details, a copy of the original purchase receipt and payment of $9.95 for delivery of the Bonus Gift. Claimants are required to pay $9.95 for the delivery of the Bonus Gift. Payment can be made with a valid Australian MasterCard or Visa Credit Card, by cheque or Money Order made payable to Salton (Aust) Pty Ltd. The Bonus Gift will only be awarded once the Promoter receives a copy of the original purchase receipt and payment of $9.95 for postage & handling together with full contact details. Original purchase receipts are not required. No responsibility is accepted for late, lost or misdirected mail. All claims must be carried out by the actual purchaser of the Participating Product. Claims or registrations by any other person will not be accepted. The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimants identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete, indecipherable or illegible claims will be deemed invalid. Multiple entries are permitted, subject to the following: (a) only one (1) claim permitted per Participating Product; (b) each claim must be submitted separately and in accordance with claim requirements; and (c) a maximum of two (2) claims permitted per household. All valid claims received by the Promoter where Participating Product has been purchased will be awarded the following bonus gift of 1 x McKenzies Hamper ("Bonus Gift") (RRP $49.00). The Promotion may be extended at the Promoters absolute discretion. Purchases of Participating Products after termination of this promotion will be invalid. Claimants should allow at least 30 days from the date their claim form and original purchase documentation is received by the Promoter, to receive their Bonus Gift. The Promoters decision is nal and no correspondence will be entered into. The Promoter reserves the right to reclaim from any claimant the Bonus Gift, if the initially purchased Participating Product is returned after the claim has been processed and fullled. This clause does not limit or affect the claimants rights with regards to warranties on the Participating Product either from the manufacturer or implied by legislation. If the Bonus Gift is unavailable, the Promoter, in its discretion, reserves the right to substitute the Bonus Gift with a gift to the equal value and/or specication. The Bonus Gift is not transferable or exchangeable and cannot be taken as cash. If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the offer, as appropriate. Except for any liability that cannot be excluded by law, the Promoter (including its ofcers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the offer, including, but not limited to, where arising out of the following: (a) any technical difculties or equipment malfunction (whether or not under the Promoters control); (b) any theft, unauthorised access or third party interference; (c) any claim, original purchase documentation or Bonus Gift that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the Bonus Gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of a Bonus Gift. Certain legislation may imply warranties or conditions or impose obligations upon the Promoter which cannot be excluded, restricted or modied or cannot be excluded, restricted or modied except to a limited extent. These Terms and Conditions must be read subject to those statutory provisions and will not affect any statutory rights that a claimant may have in relation to the return of a Participating Product or Bonus Gift. The Promoter collects personal information in order to conduct the offer and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, offer suppliers and as required, to Australian regulatory authorities. Validity of a claim is conditional on providing this information.
