CONDITIONS OF SALE FOR AUCTION
1) A 11% (GST Inclusive) Buyers Premium applies to the knockdown price of each item sold excluding Vehicles, Skid Steer, Mini Excavator, Prime Movers, Trailers & Dolly which are 7.7% (GST Inclusive). GST IS INCLUDED IN THE KNOCKDOWN PRICE. If you intend bidding you must register at the office where you will be required to fill out and sign a Buyers Card which states that you understand the Terms and Conditions of Sale. You must produce photo identification e.g. drivers licence. You will then be given a BUYERS NUMBER which is yours for this sale only. You must register for a new number at each sale you attend. The highest bidder shall be the purchaser, subject to the Vendors approval and a reserve price if any. The Purchaser shall be deemed to be the Principal unless prior to the sale he has disclosed to the Company that he will be bidding on behalf of a Principal whose name and address shall be disclosed to the Auctioneer. The Purchaser and Vendor authorise the Auctioneer to sign the contract of sale on their behalf which, with these conditions shall, except as otherwise provided by State or Federal law, constitute the whole contract between the Vendor and the Purchaser to the exclusion of everything else. The Auctioneer may without giving reason refuse to accept the bid of any person or persons and may decline the offer for any lot or withdraw any lot or lots from sale. A bid shall be deemed to be accepted unless the Auctioneer forthwith, after it has been made, declares his non-acceptance or dissent. Should any dispute arise to any bid the relevant lot or lots may, at the option of the Auctioneer, be put up again and resold. Each buyer, immediately after any lot is knocked down, shall if requested by the Auctioneers Clerk, sign a contract of sale and immediately pay in CASH, CERTIFIED BANK CHEQUE, EFTPOS or DIRECT CREDIT a deposit of not less than 10% of the purchase price. The whole of the lots having been made available for inspection, no allowance or refunds will be made, nor will any buyer be permitted to reject any lot on the grounds that it is not correctly described in the catalogue or by the Agent or its staff. The said lots are taken with all faults (if any) and will be at the Buyers risk on the fall of the hammer and, thereafter, the Vendor will be free of all responsibility for safeguarding the goods and will not be liable for any loss of or damage to the goods sold whether such loss or damage is caused or contributed to by any act of neglect or default of the Vendor, its servants, employees or agents. The balance of purchase price shall be paid in CASH, CERTIFIED BANK CHEQUE, EFTPOS or DIRECT CREDIT no later than 12 noon Friday 10 June 2011. Should any deficiency arise between the quantity of goods described at the time of sale and that available at the time of delivery, the purchaser shall take and the Auctioneers shall be required to effect delivery of, only the quantity actually so available. No compensation will be paid in respect of any such deficiency but the buyer may claim a pro-rata adjustment of purchase price as determined by the Auctioneer. No adjustment will be made unless the buyer makes a claim at or before the time of delivery. All goods which have been paid for in full must be removed by the purchaser at the purchasers expense by 3.00 pm Friday 10 June 2011. No goods to be removed prior to the completion of the auction. Upon any purchaser failing to comply with any of the above conditions all monies received in part payment shall be absolutely forfeited to the Vendor after the Agents commission and costs, and all lots uncleared may be resold by Public Auction or Private Contract and the deficiency (if any) of such resale, together with all costs and charges attending, shall be made good by the defaulter at the sale.
