SKILL CONTEST RULES
DESCRIPTION OF THE SKILL CONTEST AND OFFERED PRIZES.
CONTEST - This skill contest, promoted by Illva Saronno S.p.A., a company with its registered office in Via Archimede 243, Saronno (Varese) Italy, VAT n. 02649100126 ("Illva") and carried out in accordance with the provisions of these rules (the "Rules"), is named "The Mixing Star" (the "Skill Contest") and consists of a talent, creativity and ability skill contest among professional bartenders, as defined below. By sending the application form available on the website www.themixingstar.eu (at the page dedicated to the Skill Contest) participants unconditionally and fully accept and agree to comply with the provisions of these Rules. Illva shall have the ability, at any time during the operation of this Skill Contest, to change: (i) the locations where each selection takes place (but as far as possible only within the relevant city where the selection is originally supposed to take place according to these Rules), (ii) the days and times when the selections take place; and (ii) one or more of the juries' members (provided that there will always be an independent member). Such changes will be binding when posted on the website www.themixingstar.eu and all participants should check the website regularly but Illva will also use reasonable efforts to contact the then current participants by telephone or email using their contact details provided during registration, where possible with 3 (three) days prior notice. DESCRIPTION OF THE SKILL CONTEST'S STRUCTURE - Applicants admitted to participate in the Skill Contest will be asked to prepare one Disaronno-based cocktail of their own invention (the "Disaronno Signature Cocktail") and one "Disaronno Sour", as defined below, in front of a judging panel, as described hereinafter in these Rules. Finalists will also be required to prepare one "Disaronno Shot", as defined below. The Skill Contest includes 3 (three) rounds (the "Preliminary Selection", the "Casting" and the "Final") described under paragraph 5.1. below. PRIZES - The 3 (three) participants who, having gone through the Preliminary Selection, and the relevant Casting, gain the highest score, as defined in paragraph 5.3 below, will be entitled to receive the prizes indicated in the table below.

The first prize consists in a round trip of 7 (seven) days (6 nights) for 1 (one) person to Los Angeles (California) USA. Departure will take place in the period between 1 January 2011 and 30 September 2011 (timing will be chosen by the participants but, in the event the first place winner is interested in making its appearance in a US TV series, must coincide with the time when shooting of the US TV series will take place, as communicated by Illva pursuant to these Rules). * The indicated value of prizes refer to their market value as at the starting date of the Skill Contest stated below. No prize substitution is allowed, cash alternatives will not be given in lieu of the prizes, nor will it be possible to request, with or without the payment of any extra money, the award of different prizes. Illva reserves the right to substitute similar prizes of equal or greater value at its discretion. Unless otherwise agreed in writing by Illva, the main prize is non-transferable and will only be awarded to and enjoyed by the first place winner. During his/her stay in Los Angeles, the first place winner will have the possibility, if she/he is interested, to make a small appearance in an episode of a US TV series playing the role of a bartender. Should the first place winner be interested in participating, Illva shall communicate to her/him where possible at least 30 (thirty) days before - the dates when shooting is scheduled, in order to allow the first place winner to make her/his trip coincide with the shooting of the relevant scene. Appearance in the series is entirely within the discretion of the relevant producers and not Illva's and may be dependent upon the participant signing further legal agreements and releases. The first place winner must arrange and pay for his/her travel arrangements to and from the airport, his/her own travel and other suitable insurance and any other costs and expenses not referred to above. The first place winner is responsible for ensuring that he/she holds a valid passport, visa, necessary travel documentation and is fit and able to travel during the period shown above. The first place winner is responsible for his/her compliance with US immigration law. Details can be found at www.usembassy.org.uk. Illva does not take responsibility for nor guarantees the performance of any contractual or other obligations of third parties associated with the provision of the prizes above and shall not be liable for any acts, failures or omissions committed by those or any other third parties. The prizes are subject to the terms and conditions of the applicable suppliers including in the case of the first prize those of any airline, hotel or tour operator. To the fullest extent permissible by law, Illva shall not be liable for any loss or damage whatsoever that is suffered or sustained as a result of participation in or use of any prize. Illva does not attempt to limit or exclude its liability for death or personal injury caused by its negligence or any other liability the limitation or exclusion of which is prohibited by law 2. PARTICIPANTS.
The Skill Contest is only open to "professional bartenders" residing in UK, Belgium, Holland, Germany, Greece and Russia (the "Countries" and, each, "Country"). For the purposes of this Skill Contest, "professional bartenders" means any person who is 25 (twenty-five) years of age or older at the starting date of the Skill Contest stated below, resides in one of the above Countries, has been employed or engaged - for at least two (2) consecutive years - in an activity primarily consisting in the preparation of cocktails and/or the pouring of alcoholic drinks in bars/pubs/clubs and the like. All applicants will be required to provide a binding declaration as part of the application process for the Skill Contest, confirming them to be a "professional bartender", as defined above, by ticking the relevant tick box. Illva may request written evidence of compliance, including through specifically appointed representatives, autonomous checks in order to ascertain the accuracy of such representation and of the data included in the application form. Entering into the Skill Contest implies acceptance of the fact that the above checks may be conducted. In the event of any misrepresentations or other inaccuracies, applicants and, if admitted, participants, may be immediately disqualified. Illva reserves the right to disqualify any person who is involved in interfering or tampering with the conduct of the Skill Contest. Employees of Illva (and its agents,
affiliates and representatives) and their families and any other person assisting directly or indirectly with the running of the Skill Contest are ineligible to enter. 3. DURATION OF THE SKILL CONTEST.
Entry for this Skill Contest is valid from h. 01:00 GMT on 15th June 2010 to h. 23:59 GMT on 07th August 2010. The final selection, whereby the 3 (three) winners will be selected, will take place on 16th November 2010. 4. SKILL CONTEST PROGRAM.
4.1. Registration. Professional bartenders, as above defined, wishing to participate in the Skill Contest must ensure that their completed application is received by Illva from h. 01:00 GMT on 15 June 2010 and by not later 1 than h. 23:59 GMT on 10 September 2010 , (the "Application Term"). Entries received after the Application Term will be invalid. The application shall be deemed successfully completed when the registration, which may only be made online from the page dedicated to the Skill Contest on the website www.themixingstar.eu, is accurately completed and the application form (inclusive of the Disaronno Signature Cocktail recipe) is received. Illva assumes no responsibility for any failure to receive an entry on account of technical problems or congestion on the Internet or on the above website. Proof of entering information on the websitedoes not constitute proof of delivery or receipt of such information. No other form of entry is permitted. In completing the application form, professional bartenders must choose, within their own Country of residence, only one Casting (i.e. the town and date on which the selection under paragraph 5.1.b. below will take place in each of the Countries) from those listed under paragraph 5.1. It is not permitted to choose more than one Casting nor to modify the one originally selected, once the application is completed. Application forms which, pursuant to these Rules and in particular paragraph 4.2 below, turn out to be invalid, will not be included within the Preliminary Selection, as defined below. Only one (1) entry per person is permitted. If more than one (1) entry is submitted by a participant during the Application Term, only the first entry received by that participant will be considered. Subject to the provisions of the release agreement permitting the use of photographs and film of the Castings and the Final (only if entered into by the participants) applicant shall keep all of their rights in their entry. 4.2. Validity Criteria of the application forms. All compulsory fields of the application form, as expressly indicated (name and surname, address, email address and phone number, date of birth, city and country of residence), must be fully completed and include the complete Disaronno Signature Cocktail name and recipe. The application form shall de deemed to be invalid (and the relevant applicant shall, consequently, not be allowed to participate in the Skill Contest) if: a. the proposed Signature corresponds, as far as its name and/or composition is concerned, to a well known and already existing cocktail/drink included, at the date on which the application form was sent, in the list of cocktails/drinks published by the International Bartender Association and available at www.iba-world.com free of charge; b. the Disaronno Signature Cocktail recipe does not contain the ingredients and/or does not comply with the requirements indicated at paragraph 4.4 below; or c. the application form is not sent within the Application Term. 4.3. Drafting of the Disaronno Signature Cocktail recipe. While completing the recipe, the bartender wishing to participate in the Skill Contest may indicate, among the relevant ingredients, the following alcoholic beverage/categories of alcoholic beverage (by selecting them from a drop-down menu): LIQUEURS: Disaronno, Absinthe, Limoncello, Coffee Liqueur, Maraschino Liqueur, Sherry, Vermouth White, Vermouth Red, Vermouth Dry, Cocoa Cream Liqueur, Fruit Liqueur, Cassis, Curaao, Triple Sec, Flavoured Liqueur, Calvados, Flavoured Vodka. DISTILLED: Armagnac, Bourbon, Brandy, Cachaa, Cognac, Gin, Rum, Scotch whisky, Tequila, Vodka, Whiskey.
This date replaces the previously indicated one of August, the 7th 2010
It will also be possible, to specify the brand and the type of one or more of the above mentioned alcoholic beverages, by indicating it in the blank "Other". The type of ice to be used will be selected by ticking the provided box and the preparation technique may be selected from a drop-down menu. The remaining ingredients, the relevant decoration/garnishes and the procedure to be used for the preparation, serving and presentation of the Disaronno Signature Cocktail may be indicated in the relevant blanks. Each participant is allowed to submit only one recipe. 4.4. Rules on how to draft a Disaronno Signature Cocktail recipe. The Disaronno Signature Cocktail recipe must be drafted as follows: (i) Name - the name of Disaronno Signature Cocktails must not: (a) include, in whole or in part, the logos and/or trade marks and/or distinctive signs or other intellectual property of any third parties, (b) be obscene, offensive or vulgar, nor (c) include sexual words and/or words associated with narcotics or motor vehicles and may not imply to have a medicinal effect. The same rules apply to the description of the ingredients and, save for reference to branded ingredients mentioned above, to the text of recipes; (ii) List of ingredients - Disaronno Signature Cocktails may not contain more than 7 (seven) ingredients (including fruit juices, syrups, drops, dashes). It is acceptable to additionally spray a citrus fruit zest over the Disaronno Signature Cocktail (the zest, shall, in this case, be expressly indicated in the recipe as garnish). (iii) Indication of the quantity (expressed in CL) of each ingredient - Disaronno Signature rd Cocktails must contain a minimum of 2 CL (2/3 oz) of Disaronno. The quantities of the ingredients must be expressed in centilitres (CL) (except for bitters/hot pepper sauce and the like, whose quantities may be expressed in dashes and/or drops). (iv) Indications concerning the procedure to be followed to create the Disaronno Signature Cocktail - Disaronno Signature Cocktails may be prepared by using one of the following preparation techniques:" Build", "Shake and Strain", "Blend" or "Layer". It may be hand stirred, hand shaken or blended in an electric mixer. Should the participant intend to use a different technique he/she may indicate so in the blank "Other". (v) List of garnishes, indication of the glassware to be used and other indications concerning the serving modalities of the Disaronno Signature Cocktail - Disaronno Signature Cocktails may be served "straight up", or over ice or crushed ice in glasses and/or other receptacles which must be described in the provided blank "Procedure " of the recipe and no brand name or logo of any type should be visible. The indicated decorations/garnishes must be edible but may be mounted on sticks, skewers, straws, forks or other such common bar accessories. Working methods described in the recipes must be hygienic, safe and lawful; (vi) General Rules - the Disaronno Signature Cocktail must be fully edible and it must be an original recipe of the participant. By entering the Skill Contest each participant confirms that their recipes have not been copied from anyone else. 5. SELECTIONS
5.1. Dates and Places. The Skill Contest consists of the following 3 (three) phases: a. "Preliminary Selection" - a panel of judges will select, not later than 30th August 2010, for each Casting a maximum number of 27 (twenty-seven) participants from all those professional bartenders from whom a valid application form has been received by Illva, by judging their relevant recipes as indicated under paragraph 5.3. b. "Castings" - a further round of judging will be held at the times and in the locations indicated in the chart under 5.3. below for each of the Countries. Each participant will be responsible for arranging his/her travel to and from their assigned Casting. No travel, accommodation or other expenses will be refunded. c. the "Final" - will be hosted in London (UK) on 16th November 2010 , from h. 10 am to h. 4 pm (UK time). A travel, accommodation and meals allowance at the hotel will be paid as a contribution to expenses of the finalists participating in the Final. 5.2. Drinks preparation and presentation - Rules Applicable to all three rounds.
DEFINITIONS - For the purposes of these Rules, a "Disaronno Sour" is a cocktail composed of 4,5 CL of Disaronno, 2 CL of liquid sugar, 1 CL of lemon juice, whose ingredients must be shaken with ice and poured into a previously cooled glass, after having filtered the ice. It has to be served into a glass garnished with a lemon slice and a maraschino cherry. For the purposes of these Rules, a "Disaronno Shot" is a 5 CL (or less) shot composed of: (i) a minimum of 1,5 CL of Disaronno; and (ii) any other edible ingredient commonly legally distributed in stores and/or bars within any of the Countries, as defined below (home-made ingredients - such as infusions or syrup - and any other ingredient which require prior preparation being expressly excluded). RULES FOR THE COCKTAILS PREPARATION AND PRESENTATION - During the relevant Casting and the Final, each participant shall prepare, in front of the relevant judging panel, 2 (two) identical Disaronno Signature Cocktails and 2 (two) identical Disaronno Sour. Also, during the Final, participants shall prepare 1 (one) Disaronno Shot. The preparation of the Disaronno Signature Cocktail shall be consistent, [insofar as it is specified thereunder, with the recipe submitted at the time of application. During the relevant Casting and during the Final, participants shall prepare the Disaronno Signature Cocktails and the Disaronno Sours within the time limit of 10 (ten) minutes for each type of cocktail but will additionally be given time to familiarize themselves with the bar area and prepare equipment and ingredients (around 5 (five) minutes before their performance). During the Final, finalists shall have a further 5 (five) minutes to prepare the Disaronno Shot. Exceeding the allocated time will result in the application of the penalty indicated in the chart below (- 10 points). Competitors serving drinks that appear inedible or working with unhygienic unsafe or unlawful methods will be disqualified. INGREDIENTS/GARNISHMENTS AND TOOLS - The ingredients and the garnishes necessary for the preparation of the Disaronno Sour and those indicated by the participants in the Disaronno Signature Cocktail recipe as selecting from the relevant menu, will be made available to the participants by Illva, at its own cost. In the event the participant has not indicated, for the beverage listed in the drop down menu, the relevant brand of the selected beverage, or if the requested brand is not for any reason available at the relevant time, Illva will provide the participant with the indicated product whose brand shall be selected by Illva at its sole discretion. Participants shall procure and carry with them, at their own costs and expense, the remaining ingredients and garnishments necessary in order to prepare the Disaronno Signature Cocktails and the cups/glasses where they intend to serve the cocktails in, should they not intend to use the standard cups/glasses provided for by Illva. Where possible at least 10 (ten) days prior to the Final, Illva shall contact each finalist, by telephone or email, requiring the list of ingredients that the finalist intends to use for the preparation of the Disaronno Shot, so as to make them available to the finalist at the Final. Participants are allowed to use their own bar tools, cocktail shakers or mixing glasses for the creation of the cocktails. Fully stocked bartender kits will in any case be supplied for the free use of the competitors in the preparation of their cocktails. Ice cubes (approx 25 CL approx 1 inch square) and an ice-crusher will also be supplied. Competitors serving drinks that appear inedible or working with unhygienic, unsafe or unlawful methods will be disqualified. Fruit for garnishes may be peeled in advance, but not sliced, wedged or pre-cut in any other way. Decorations/garnishes must be assembled within the allotted drinks preparation time. COCKTAILS' PRESENTATION - Competitors are encouraged to talk to the judges while making their drink to illustrate their preparation, and points will be awarded for general presentation of the cocktails and working methods. The presentation of the drinks will be in the competitors' local language and for the Final the necessary translators will be provided by Illva to help judges understand, unless competitor autonomously decide to speak English. In order to allow the judging panels to better identify the competitors during the presentation of cocktail and during voting sessions, snapshots of the competitor's face will be taken and given to the judges. By completing admission to the Skill Contest and accepting these Rules - the participants hereby authorize Illva, its employee, partners, consultants and/or other subjects duly authorized by Illva, to take the above mentioned snapshots during the relevant Casting and Final, for the sole purpose of providing them to the judges in order to ease identification of competitors. Notwithstanding the above, competitors will be required - but are not obliged to for the purpose of participating in the Skill Contest - to enter into a separate release agreement permitting the use of photographs and film of the Castings and the Final. The privacy notice available on the website www.themixingstar.eu, sets out, inter alia, the basis upon which Illva will process the personal information relating to the participants to this Skill Contest. 5.3. Structure of the Judging Panels, Voting and Winners' Selection.
The judging panels of each selection (the Preliminary Selection, Castings and Final) will be made up of 3 members (one of which will be an independent member). The Names of the Jurors and castings locations are still to be confirmed. Due to this, they will be indicated in the present Skill Contest Rules th within the 15 of July 2010.
PRELIMINARY SELECTION - Those competitors - up to a maximum number of 27 (twenty - seven) for each Casting - whose recipes are awarded the highest total score will be admitted to the relevant Casting. The recipes will be selected in accordance with the judging categories "Taste and balance", "Creativity" and "Originality of the cocktail name" indicated in the table below. Each judge will award, for each applicable category and cocktail, the number of points included in the range below (minimum and maximum scores included). In case of a tie between two or more participants, the participant whose recipe was awarded the higher score in relation to the "Taste and balance" category will be admitted. In case of a further tie the jury will take the remaining categories ("Creativity" and "Originality of the cocktail name") into consideration one after the other. Finally, in case of a further tie, the independent judge's decision will prevail. CASTING - Competitors admitted to and participating in each Casting will be judged in accordance with the judging categories indicated in the table below and for each category (if expressly indicated in the table) points included in the range below will be awarded by each judge. The competitor who, for each Casting, (forming 10 finalists in total) is awarded the highest total score (equal to the sum of the points awarded by all the judges forming the judging panel of the Casting for each of the above categories (the Casting Total Score) will be admitted to the Final. In case of a tie between two or more competitors, the competitor who was awarded, for the Disaronno Signature Cocktail, the higher score in the "Technique" category (and, subsequently, in case or further ties, in the remaining categories, to be taken into consideration in the order indicated in the chart below) will be admitted to the Final. Finally, in case of a further tie, the independent judge's decision will prevail. FINAL - The 3 (three) finalists who are awarded the highest total scores (equal to the sum of the points awarded by all the judges forming the judging panel of the Final for each of the above categories and the Casting Total Score) (the Total Score) shall be awarded the prizes indicated in paragraph 1. In case of a tie between two or more finalists, the finalist who was awarded, for the Disaronno Signature Cocktail, the higher score in the "Technique" category (and, subsequently, in case or further tie, in the remaining categories, to be taken into consideration in the order indicated in the chart below) will be awarded the prizes. The competitors must be fully aware that the judges will not be able to consume an entire shot/cocktail during the judging process so they must consider how best to present and deliver their idea within that limitation.
6. PRIZE AWARD. Prizes will be awarded to the relevant winners at the expenses of Illva by and not later than 180 days (6 months) from Final. If any of the winners are not able, for whatever reason, to accept their prize or fail to claim possession of their prize within thirty (30) days of the participant being notified to be a winner to this contest, then Illva reserves the right to award the prize to the next highest scoring competitor. Decisions of Illva and its judges in the operation of this Skill Contest will be final and no correspondence will be entered into. If, for any reason at any time, the Skill Contest is not capable of running as planned, including due to technical failure, human error or other causes beyond Illvas control, Illva may modify, cancel, terminate, suspend or extend the Promotion without liability (to the maximum extent permitted by applicable law). Illva, acting reasonably, also reserves the right to delay the timing of any element of the Skill Contest. Details of the winners will be posted on the www.themixingstar.eu website. In addition, to obtain this information (and the identity of the independent judges if different from above) please send a self-addressed stamped envelope to: Illva Saronno S.p.A., Via Archimede 243, Saronno (Varese) Italy, th before the 16 of December 2010. 7. GOVERNING LAW AND JURISDICTION. These Rules shall exclusively be governed by the laws of England & Wales. The courts of residence of the participant shall have non-exclusive jurisdiction on all disputes and proceedings out of or in connection with these Rules including its validity.
