Administrative Appeal Decision
By letter received June 1, 2005, Appellant, through Representative, has requested an Administrative Appeal of a state hearing decision rendered May 18, 2005. The state hearing overruled the Appellants appeal, finding that the Marion County Department of Job and Family Services appropriately proposed to terminate the Appellants Ohio Works First (OWF) benefits and remove the Appellant from the food stamp assistance group.
The assistance group consists of the Appellant and her eighteen year old son who is graduated from high school in May, 2005. May 2005 was the Appellants last month of potential OWF eligibility. The Appellant attended a self-sufficiency contract reassessment on 04/04/05. The Appellant cannot attend a job site due to a disability and had completed all of the alternative work assignment pamphlets that the Agency had to offer. The Agency proposed that the Appellant be assigned to complete time logs of how the Appellant spent her day as her alternative work assignment. The Appellant refused, stating that the activity was pointless and that it was none of the Agencys business how the Appellant spent her time. The Appellant refused to sign the self-sufficiency contract and the Agency proposed termination of the Appellants OWF benefits and removing the Appellant from the food stamp assistance group.
The Appellants representative argues that the self-sufficiency contract must include a plan

for reaching self-sufficiency and that the assignment proposed by the Agency was busy work and would not help the Appellant achieve self-sufficiency. The Appellant correctly notes that the goal of the self-sufficiency contract is to assist the individual in attaining self sufficiency and personal responsibility through unsubsidized employment.1 Individuals who are unable to
participate in a work activity, due to a temporary or permanent barrier to participation, can be assisgned to an alternative work activity.2 ORC 5107.64 lists some examples of alternative work activities. Unlike work activities, the listed alternative work activities center on life issues that may affect an individuals ability to move toward sef-sufficiency. The listed activities include parenting and life skill classes, participation in programs for drug or alcohol abuse or domestic violence, or participating with the Rehabilitation Services Commission. The Agency indicated that the purpose of the activity was to allow the Appellant to assess whether she was using her time productively to move toward the goal of self sufficiency. While we agree that this would not make sense as a long-term assignment, it is sufficient for one month.
Ohio Admin. Code 5101:1-3-15 provides that, Failure or refusal to sign the self-sufficiency contract as set forth in section 5107.14 of the Revised Code results in denial or termination of OWF for the assistance group. The Appellant refused to sign the self-sufficiency contract and the termination of OWF was correct.
Ohio Admin. Code 5101:4-3-09(H) states that failure or refusal of an individual to sign an OWF self-sufficiency contract results in the individual being ineligible for food stamps. However, the rule specifically states, [T]he county agency must stop the food stamp sanction or disqualification when it becomes aware that the person has become ineligible for OWF for some other reason.3 Because the Appellant became ineligible for OWF in June because she had no minor children in her home, her failure to sign the self-sufficiency contract should not affect her food stamp eligibility from June forward. The Appellant should be aware, however, that she will be required to participate in Food Stamp Employment and Training Program unless she otherwise determined exempt.

DECISION Accordingly, we must ORDER that the state hearing decision be AFFIRMED but COMPLIANCE issue to the county to redetermine the Appellants eligibility for food stamp benefits, if they have not already done so. The county is directed to send the Appellant written notice of the action
taken as a result of this decision via an ODJFS 4074, 4065, 7334, 7401, 4701 or other appropriate state form. The county is to attach a copy of this notice to the ODJFS 4068 State Hearing Compliance form. The Appellant retains all state hearing rights regarding any future agency determination.
